(3) For valid participation, participants must provide the following information on the above-mentioned website:
- In which EDEKA Breidohr store the purchase was made
- Which Seeberger product was purchased
- A valid e-mail address
By participating in the competition, the participant agrees to these conditions of participation and the data protection regulations (§ 8).
§ 3 Competition
(1) The competition will take place in the period from 27.10.2025 up to and including 02.11.2025. The closing date for entries is 02.11.2025 at 23:59.
(2) A total of 10 winners will be selected at random from all valid entries.
(3) The prizes are: 10x Seeberger snack package, consisting of:
- 1x Vaude backpack
- 15x 15g bags of freeze-dried Seeberger blueberries
- 12x 15g bags of freeze-dried Seeberger strawberries
(4) The winners will be notified by email at the end of the entry period. If a winner does not respond within 14 days of the notification being sent or if no delivery address in Germany is provided, the prize will be forfeited without substitution.
(5) A cash payment, exchange or transfer of the prize to third parties is excluded.
(6) The participant is responsible for the accuracy of the contact details provided. If the contact details are incorrect, the organizer accepts no responsibility for the non-deliverability of the prize notification or the prize.
§ 4 Warranty exclusion, premature termination of the promotion
(1) The organizer points out that the availability and function of the promotion cannot be guaranteed. The promotion may be terminated or removed due to external circumstances and constraints, without this giving rise to any claims by participants against the organizer. The organizer is entitled to change the design of the promotion and the conditions of participation at any time due to special conditions, provided this is necessary for the organizer and reasonable for the participants. This may include, for example, technical problems, changes in the law, force majeure events or attacks by third parties against the campaign website.
(2) The organizer reserves the right to cancel or terminate the campaign at any time without prior notice. The organizer will make use of this option in particular if, for legal or technical reasons (e.g. manipulation, hacker attacks or errors in the hardware and/or software, etc.), proper implementation of the campaign can no longer be guaranteed. After the end of the promotion, it can be declared invalid if it cannot be ruled out on the basis of findings that the promotion has been manipulated and this could have had an influence on the result or the chance of winning.
(3) If the conduct of a participant has caused the promotion to be terminated prematurely or ended prematurely, the organizer can demand compensation from this person for the resulting damage.
(4) The organizer assumes no guarantee that the prizes are free of defects, unless they are the organizer's own products.
§ 5 Exclusion from participation
If a participant violates these conditions of participation or legal regulations, uses unauthorized aids or otherwise obtains advantages through manipulation or attempts to do so, the organizer may exclude this participant from the competition. In this case, all claims against the organizer, in particular for the prize, are excluded. Anyone who provides false personal details may also be excluded.
§Section 6 Liability
(1) The following exclusions and limitations of liability shall apply to the Organizer's liability for damages, notwithstanding the other statutory requirements for claims in accordance with Section 6.
(2) The Organizer shall be liable without limitation insofar as the cause of the damage is based on intent or gross negligence. Furthermore, the organizer shall be liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfilment of which is essential for the proper execution of the campaign and on the observance of which the contractual partners regularly rely. In this case, however, the organizer shall only be liable for the foreseeable damage typical for the contract. The organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.
(3) The above limitations of liability in accordance with paragraph 2 do not apply in the event of injury to life, body and health, for a defect following the assumption of quality guarantees for the quality of a product and in the event of fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.
(4) If claims are made against the Organizer due to violations of the law or these Terms and Conditions of Participation for which the participants are responsible, the participants shall indemnify the Organizer against the claims to the extent of their responsibility upon first request and support the Organizer in defending against the claims. The indemnification includes the necessary legal defense costs.
(5) Insofar as the liability of the organizer is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of the organizer.
§ 7 Miscellaneous
(1) Legal recourse is excluded.
(2) Should individual provisions of these conditions of participation be or become invalid, this shall not affect the legal validity of the remaining conditions of participation. They shall be replaced by an appropriate provision that comes closest to the purpose of the invalid provision.
(3) These conditions of participation may be amended by the organizer at any time in the future.
